Welcome to the functionalhand® Affiliate Program (the “Program”), operated by Thera-Solutions, LLC, an Illinois limited liability company based in Elmhurst, Illinois (“Thera-Solutions,” “we,” “us” or “our”). These Terms & Conditions (“Agreement”) govern your participation as an affiliate (“Affiliate,” “you”) in the Program. By applying to, or participating in, the Program, you agree to be bound by this Agreement. If you do not agree, do not apply to or participate in the Program.
1. Eligibility and Registration
You must complete the Program application and be approved by Thera-Solutions before promoting functionalhand® products as an Affiliate. We reserve sole discretion to approve, reject, suspend, or remove any applicant or Affiliate, with or without cause, and our decision is final.
You must be at least 18 years old and legally able to enter into this Agreement.
You must provide accurate, current registration, tax, and payment information and keep it up to date.
2. Nature of the Relationship
You participate in the Program as an independent contractor. Nothing in this Agreement creates an employment, agency, partnership, joint venture, franchise, or distributorship relationship between you and Thera-Solutions. You have no authority to make representations, warranties, or commitments on behalf of Thera-Solutions, to bind Thera-Solutions in any way, or to hold yourself out as an employee, agent, representative, or authorized distributor of Thera-Solutions.
3. Affiliate Links, Codes, and Tracking
Thera-Solutions will provide you with a unique tracking link and/or discount code to identify orders you refer.
Referral attribution. An order is attributed to an Affiliate only if the customer either (a) enters that Affiliate’s unique discount code at checkout, or (b) completes the purchase using that Affiliate’s tracking link, as recorded by our tracking platform. It is the Affiliate’s sole responsibility to ensure that referred customers actually use the Affiliate’s discount code or tracking link when purchasing. Thera-Solutions is not responsible for identifying, reconstructing, or crediting a referral where the customer did not use an identifiable discount code or tracked link, regardless of any other communication, promotion, or relationship between the Affiliate and the customer. If a customer’s order includes no identifiable discount code or tracked link, it is not treated as a referred order and no commission is payable. If a customer uses one Affiliate’s discount code after clicking a different Affiliate’s tracking link, the order is attributed to the Affiliate whose discount code was used at checkout. Commission is earned only on completed, paid orders that are attributed under this section.
4. Commission, Customer Discount Codes, and Payment
Commission rate. Thera-Solutions pays Affiliates a commission of 15% of the net order value (excluding shipping and applicable taxes) on qualifying, completed, paid orders placed through your tracking link or discount code.
Customer discount code. Your unique discount code offers your referred customers 10% off their qualifying order. This customer-facing discount is separate from, and does not reduce, your 15% commission – you are paid 15% of the net order value regardless of the 10% discount the customer received.
Approval period. Commissions are marked “pending” until the associated order’s applicable return/cancellation window has passed (currently [30] days), at which point they become “approved” and eligible for payout.
Payment schedule. Approved commissions are paid on the last day of each month, subject to a minimum payout threshold of [$5]. Amounts below the threshold roll over to the next payment cycle.
Returns, refunds, cancellations, chargebacks, and fraud. Commissions are earned only on completed, paid orders. If an order is returned, refunded, cancelled, disputed (chargeback), or determined to be fraudulent or otherwise invalid, any commission associated with that order will be reversed or deducted from your account, including from future payments if necessary.
Self-referrals. You may not earn a commission on your own purchases, purchases made on your behalf, or purchases made using accounts you own or control, unless Thera-Solutions expressly authorizes this in writing in advance. Orders identified as self-referrals will not be paid and may be reversed if already paid.
You are solely responsible for any taxes owed on amounts paid to you under this Agreement, and Thera-Solutions may request tax documentation (e.g., a Form W-9 or W-8) before releasing payment.
5. Marketing Guidelines
5.1 Required Disclosure (FTC Compliance)
You must clearly and conspicuously disclose your affiliate relationship with Thera-Solutions in every post, page, video, email, or other content where you promote functionalhand® products, in accordance with the FTC’s Endorsement Guides. The disclosure must be easy to notice and understand – not buried in a bio, behind a “more” link, or only in a video description if the claim is made on-screen. Approved sample language includes:
“I may earn a commission if you purchase through this link.” / “This is an affiliate link – if you buy through it, I may earn a small commission at no extra cost to you.”
You are responsible for complying with the FTC Endorsement Guides and any other applicable advertising laws in the jurisdictions where you promote functionalhand® products.
5.2 No Unapproved Medical or Therapeutic Claims
Affiliates may describe their own genuine experience with functionalhand® but may not make medical, clinical, therapeutic, diagnostic, treatment, prevention, or outcome claims that have not been expressly authorized in writing by Thera-Solutions, LLC. Affiliates must use accurate product descriptions and approved marketing materials and may not guarantee outcomes or represent that use of functionalhand® will produce a particular medical or functional result.
You may only use product claims supplied or approved by Thera-Solutions. Do not state or imply that functionalhand® treats, cures, prevents, or improves any specific diagnosis or medical condition unless Thera-Solutions has specifically approved that claim in writing.
5.3 Testimonials
You may share your own genuine experience (for example, that functionalhand® helped you or someone you know use a utensil more independently). You may not generalize a personal experience into a promise or guarantee that others will achieve the same or similar results. All testimonials must reflect your (or your source’s) actual, honest experience, consistent with FTC endorsement requirements.
5.4 Trademark and Brand Use
Thera-Solutions may make available certain logos, product photos, copy, and marketing materials (“Marketing Materials”). You may use the functionalhand® name, logo, and Marketing Materials solely to promote functionalhand® products through the Program, and only while you are an active, approved Affiliate. You may not:
- Alter, distort, or combine our logo or trademarks with other content;
- Create websites, social handles, or domain names that include “functionalhand,” “Thera-Solutions,” or confusingly similar terms, or that could be mistaken for an official Thera-Solutions property;
- Imply that you are an employee, agent, authorized distributor, or representative of Thera-Solutions; or
- Use our brand assets for any purpose other than promoting functionalhand® products under this Agreement.
All rights, title, and interest in the functionalhand® trademark, logo, and Marketing Materials remain the exclusive property of Thera-Solutions. This Agreement grants you a limited, revocable, non-exclusive, non-transferable license to use these assets solely as described above.
5.5 Paid Advertising Restrictions
You may not bid on, purchase, or use as keywords in any paid search or social advertising (including Google Ads, Bing Ads, and similar platforms) the terms “functionalhand,” “functional hand,” “Thera-Solutions,” or any confusingly similar variation or misspelling, whether alone or combined with other terms, unless Thera-Solutions specifically authorizes this in writing in advance.
5.6 Coupon and Deal Sites
You may not list your discount code or affiliate link on coupon, deal, cashback, or discount-aggregator sites unless Thera-Solutions has specifically approved that site in advance in writing. Commissions generated in violation of this section may be reversed.
5.7 Timeline expectation
You are expected to post a minimum of one Instagram Reel within the first 30 days of receiving the functionalhand® or if you have a functionalhand® within 30 days of acceptance in this Affiliate program.
6. Program Changes
Thera-Solutions may modify commission rates, the customer discount percentage, this Agreement, or other Program terms at any time. We will provide you with reasonable advance notice (currently, no less than [15] days and no more than [30] days) of material changes, such as by email or posting an updated Agreement, before the change takes effect. Changes apply prospectively to orders placed after the effective date of the change, not retroactively to previously approved commissions.
7. Term and Termination
Termination for convenience. Either you or Thera-Solutions may terminate your participation in the Program at any time, for any or no reason, by providing notice.
Immediate termination for cause. Thera-Solutions may terminate your participation immediately, without notice, if we determine, in our reasonable discretion, that you have engaged in fraud, deceptive or misleading marketing, unauthorized medical or therapeutic claims, trademark or brand misuse, violation of FTC disclosure requirements, or any other material breach of this Agreement.
Commissions upon termination. Commissions that were legitimately earned on completed, paid orders through your termination date will be paid according to the normal payment schedule and approval process described in Section 4. Thera-Solutions may withhold or reverse any commission connected to fraud, a violation of this Agreement, or a return, refund, cancellation, or chargeback, regardless of when the underlying order occurred.
8. Disclaimers and Limitation of Liability
The Program and any Marketing Materials are provided “as is.” Thera-Solutions makes no warranties regarding the Program’s uninterrupted availability or the accuracy of tracking. To the maximum extent permitted by law, Thera-Solutions’ total liability to you arising out of this Agreement will not exceed the total commissions paid to you in the three (3) months preceding the event giving rise to the claim.
9. Indemnification
You agree to indemnify and hold Thera-Solutions harmless from any claims, damages, or expenses (including reasonable attorneys’ fees) arising out of your breach of this Agreement, including unauthorized medical or therapeutic claims, trademark misuse, or violation of applicable advertising or endorsement laws.
10. Governing Law and Venue
This Agreement is governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to this Agreement will be resolved exclusively in the state or federal courts located in DuPage County, Illinois, and you consent to personal jurisdiction there.
11. General
This Agreement, together with the Privacy Policy below and any other Program policies referenced herein, is the entire agreement between you and Thera-Solutions regarding the Program.
If any provision is found unenforceable, the remaining provisions remain in effect.

This Privacy Policy describes how Thera-Solutions, LLC (“Thera-Solutions,” “we,” “us,” or “our”) collects, uses, and shares personal information in connection with the functionalhand® Affiliate Program (the “Program”), which we operate using the Solid Affiliate affiliate management platform. This Policy applies to Affiliates who apply to or participate in the Program. It describes our actual data practices for the Program – it does not list categories of data we don’t actually collect or share.
1. Who This Policy Covers
This Policy applies to individuals who apply to become, or who participate as, an Affiliate in the functionalhand® Program. It does not cover customers who purchase functionalhand® products, whose information is handled under our separate Customer Privacy Policy.

3. How We Use Your Information
To evaluate and process your Program application;
To track referrals and calculate, approve, and pay commissions;
To communicate with you about the Program, including policy or commission changes;
To monitor for fraud, invalid orders, or violations of our Affiliate Terms & Conditions; and
To comply with legal and tax obligations (for example, issuing required tax forms).
4. Cookies and Tracking
We use the Solid Affiliate platform to attribute purchases to the correct Affiliate. If a customer enters an Affiliate’s unique discount code at checkout, the order is attributed to that Affiliate. If no discount code is used, we use a tracking cookie set when a visitor clicks an Affiliate’s tracking link; if that visitor completes a purchase within the cookie’s expiration window, the order is attributed to the Affiliate whose link was most recently clicked. If a customer’s order includes neither a discount code nor a tracked link within the applicable window, we have no way to associate that order with any Affiliate, and no referral information is recorded.
5. Who We Share Information With
We do not sell your personal information. We share Affiliate information only with:
Service providers who help us operate the Program, currently including Solid Affiliate (affiliate tracking software) and our e-commerce and payment processing providers, each of whom is contractually required to protect your information and use it only to provide services to us;
Professional advisors (such as our accountant) where necessary to process payments or meet tax obligations; and
Others, only with your consent, or where required by law (for example, in response to a valid legal request).
6. Data Retention and Security
We retain Affiliate information for as long as you participate in the Program and for a reasonable period afterward to comply with tax, accounting, and legal obligations and to resolve any disputes. We use reasonable administrative and technical safeguards to protect your information, though no method of storage or transmission is completely secure.
7. Children
The Program is not directed to, and is not intended for use by, individuals under 18. We do not knowingly collect personal information from children in connection with the Program.
8. Your Rights and Choices
You may contact us to:
- Access or request a copy of the personal information we hold about you;
- Correct inaccurate information;
- Request deletion of your information, subject to our legal, tax, and recordkeeping obligations; or
- Withdraw from the Program at any time.
To exercise any of these rights, contact us using the information in Section 10 below.
9. Changes to This Policy
We may update this Policy from time to time. If we make material changes, we will notify Affiliates (for example, by email or by posting an updated Policy) before the change takes effect. Continued participation in the Program after an update constitutes acceptance of the revised Policy.
